1. INTRODUCTION

These Terms and Conditions ("Terms") govern your use of the website www.algotradepro.com (the "Site") and all products and services offered by AlgoTrade Pro ("AlgoTrade Pro", "we", "us" or "our"), including free content, paid subscriptions, lifetime access products and source code products (together, the "Services"). If you do not agree with these Terms, please do not use the Site or the Services.

2. ACCEPTANCE OF TERMS

By accessing the Site, purchasing or using any of the Services, you agree to be bound by these Terms, our Privacy Policy and our Disclaimer. These Terms form a binding agreement between you and AlgoTrade Pro.

3. CHANGES TO THESE TERMS

We may update these Terms at any time. Changes take effect when published on this page, and your continued use of the Site or the Services after publication means you accept the updated Terms. You are responsible for reviewing this page periodically. Material changes do not affect the content or scope of products you have already purchased.

4. USE OF THE SITE AND SERVICES

You agree to use the Site and the Services only for lawful purposes and in accordance with applicable laws. You must not use them to infringe intellectual property rights, commit fraud, distribute harmful or malicious content, or interfere with the operation of the Site or the Services.

5. ACCOUNT RESPONSIBILITY

Some features may require an account on our Site or on a third-party platform (such as Patreon, TradingView or Discord). You are responsible for keeping your login details confidential and for all activity under your account. You must notify us promptly of any unauthorized use. We are not liable for losses caused by your failure to protect your account.

6. SUBSCRIPTION SERVICES

6.1 Some Services require a paid monthly subscription. You agree to pay the fees for the plan you choose, as shown at the time of purchase.

6.2 Subscription fees are non-refundable, except where a refund is required by applicable law.

6.3 We may modify, pause or discontinue subscription plans. Where a plan is paused or discontinued, active subscribers will be notified in advance, will not be charged for further billing periods, and will keep access until the end of the period already paid.

7. LIFETIME ACCESS

7.1 Source code products. For lifetime plans that include source code, "lifetime" means that you receive the source code in its version at the time of delivery and may keep and use it permanently, under the license described in Section 12. Future updates to these scripts are not included unless expressly stated.

7.2 Signal Engine. For the Elite lifetime plan, Signal Engine access is granted as invite-only access on TradingView to the TradingView username you provide. "Lifetime" means this access is not subject to renewal or recurring fees and includes future updates published to that script. Because Signal Engine runs on TradingView, its availability also depends on TradingView's platform and policies, as described in Section 10.

7.3 Lifetime access is personal to you and may not be transferred, shared or resold.

8. LIFETIME PLANS OFFER (OCTOBER 2026)

8.1 Plans. The following lifetime plans are offered:
- Core Lifetime: Premium Indicators Testing Bot.
- Pro Lifetime: the 4 ATP Portfolio Strategies (Crypto, Forex, Stocks and Commodities) and the Premium Indicators Testing Bot.
- Elite Lifetime: Signal Engine access including future updates, the 4 ATP Portfolio Strategies, the Premium Indicators Testing Bot and lifetime access to the Premium Discord.
Only the items listed for each plan are included.

8.2 Availability. The offer is available until October 30, 2026, at 23:59 (UTC time).

8.3 Delivery. After purchase, you must send an email to info@algotradepro.com with (a) your TradingView username, (b) proof of purchase and (c) the plan purchased. Elite buyers must also include their Discord username. Products are delivered by email within 24 hours of receiving this information. For the Elite plan, Signal Engine access is granted to the TradingView username provided; to ensure access is granted before November 1, 2026, you must send your email as soon as possible after purchase. We are not responsible for delays caused by missing or incorrect information.

8.4 Performance information. Strategy results shown on our Site and in our materials come from historical backtests, not live trading. Past performance does not guarantee future results.

9. RIGHT OF WITHDRAWAL FOR DIGITAL CONTENT

Our products are digital content. By completing your purchase, you expressly request that delivery begins before the end of the legal withdrawal period, and you acknowledge that you lose your right of withdrawal once the content (source code or Signal Engine access) has been delivered to you. Before delivery, you may cancel your purchase by contacting info@algotradepro.com. This does not affect any rights you have under mandatory consumer protection laws.

10. PAYMENT AND BILLING

Payments are processed by third-party payment providers, such as Patreon. You agree to provide accurate and complete billing information. We are not responsible for errors, failed transactions or charges caused by third-party payment providers.

11. THIRD-PARTY PLATFORMS

Some products are delivered through or depend on third-party platforms, including TradingView, Patreon and Discord, which AlgoTrade Pro does not own or control. We are not responsible for outages, policy changes, or the removal of scripts, content or accounts by these platforms. Loss of access caused by a third-party platform does not constitute a failure of our Services.

12. INTELLECTUAL PROPERTY

All content on the Site and in the Services, including text, graphics, logos, indicators, strategies, scripts and software, is owned by AlgoTrade Pro or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify or create derivative works from it without our prior written permission, except as permitted in Section 13.

13. SOURCE CODE PRODUCTS: LICENSE

13.1 When you purchase a product that includes source code, you receive a personal, non-exclusive, non-transferable license to use the code solely for your own trading and analysis.

13.2 You may not share, resell, sublicense, distribute or publish the code, in whole or in part, including on TradingView or any other platform, whether free or paid.

13.3 Any breach of this license automatically terminates it, and AlgoTrade Pro may take legal action to protect its rights.

14. DISCLAIMERS AND LIMITATION OF LIABILITY

14.1 The Site and the Services are provided "as is" and "as available", without warranties of any kind regarding accuracy, reliability, availability or fitness for a particular purpose.

14.2 Our tools are for educational and analytical purposes only and do not constitute financial, investment or trading advice. Trading involves a high risk of loss, and you are solely responsible for your trading decisions.

14.3 To the fullest extent permitted by law, AlgoTrade Pro is not liable for any indirect, incidental or consequential damages, including trading losses. Our total liability for any claim is limited to the amount you paid for the relevant Service.

15. USER CONTENT

You are responsible for any content you submit through the Site or our community channels. By submitting content, you grant AlgoTrade Pro a perpetual, worldwide, royalty-free, non-exclusive license to use it for purposes related to the Site and the Services. You confirm that you have the rights to that content and that it does not infringe the rights of any third party.

16. TERMINATION

We may suspend or terminate your access to the Site or the Services at our discretion, including for breach of these Terms. For paid products, access will only be terminated for breach of these Terms. Upon termination, you must stop using the affected Services.

17. GOVERNING LAW

These Terms are governed by the laws of Portugal. Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your country of residence.
